These terms govern your use of the Eldear app. By using Eldear you agree to them. If you don't agree, please don't use the app.
Eldear helps a family stay in touch and organised. It does not provide medical advice, diagnosis or treatment, and its wellbeing trends are general information — not a clinical assessment. Nothing in the app should replace professional medical judgement.
Eldear is not an emergency response system. It does not call emergency services and cannot guarantee that anyone will see or act on a notification. Never use Eldear as the only way of getting help to someone.
Check-ins, reminders and alerts depend on phones, watches, internet connections, background permissions and Apple's notification service — none of which we control. Messages may be delayed, duplicated or not delivered at all. Please don't build a care plan that depends on any single notification arriving.
You need an account to use Eldear. Keep your sign-in secure, give accurate information, and don't share your family code with anyone you don't want inside your family's information.
Eldear is built on the understanding that the cared-for person knowingly agrees to share. You must not set up or use Eldear to observe someone without their informed consent. The cared-for person can change or stop sharing at any time, and you agree to respect that.
Don't misuse Eldear. In particular, don't use it unlawfully, don't try to access other families' data, don't attempt to disrupt or reverse-engineer the service, and don't upload content you have no right to share.
Documents, notes and other content you add remain yours. You grant us only the permission needed to store and display that content to your family so the app can work.
We may change, suspend or discontinue parts of Eldear, and we may update these terms. We aim to keep the service running but do not guarantee uninterrupted availability.
Eldear is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the extent permitted by law, we are not liable for indirect or consequential loss, or for any harm arising from missed, delayed or undelivered notifications, or from reliance on the app in place of medical care or emergency services. Nothing here limits liability that cannot legally be limited, including for death or personal injury caused by negligence.
You may stop using Eldear and delete your account at any time from Settings. We may suspend accounts that breach these terms.
These terms are governed by the laws of the Federal Republic of Germany, without affecting any mandatory consumer protections you have where you live.
